Arctic Case Gets A Date At The Court of Appeal

It has been announced that the Court of Appeal will hear the Arctic case on the 17 and 18 January 2006.

If successful, the amount the Revenue will receive from each case is relatively small, however, because of the number of cases the legislation could be applied to it is estimated that in total the Revenue stand to gain £1bn.

As the Master of the Rolls considers the case to be of significant public importance the hearing will include the Vice Chancellor. This confirms the long held views by the accountancy profession and all businesses affected, that this is indeed an important case and its impact could have profound consequences in the business community. It is also encouraging that other experts in this field agree with Qdos that the Revenue's view of the matter is not only unfair but also wrong in law.

Unfortunately the decision will not be received before the 31 January 2006 and so it will be too late to affect the Returns for the year ended 5 April 2005 as they are required to be submitted before 31 January 2006.
